Legal Question in Credit and Debt Law in New York
employer used my credit card
My former employer used my credit card while I was out on Maternity leave. The total was over $13,000.00 Becasue I accepted the words from him ''I will pay you'' and he never did the credit card companys says I'm responsibile. Can I take him to court for that money? He also has moved out of The US since this occured but still owns a property in New York

Re: employer used my credit card
A complete answer to your question is not possible since you did not provide complete facts (chronology) of the events. IF the card was used without your authority and/or knowledge YOU WOULD NOT BE RESPONSIBLE in my view. If your post use acceptance of the charges was not in writing I do not think the oral statement should be enforceable...NOR SHOULD YOU EVER ADMIT YOU SAID THEM WITH THE UNDERSTANDING THAT YOU WOULD BE LIABLE. You did state that you employer said he would pay you so you thought that's where the funds would come from...not that you would lay out the funds and then try to get funds from the employer...don't ask the credit card company for their opinion all they want is your money...
You may be sued by the credit card company but your defense is that YOU NEVER AUTHORIZED THE USE OF THE CARD. You'll probably never get any funds from the employer since he's out of the country and IF the credit card company improperly handled the non-authorized transactions let them chase him...good luck
