Legal Question in Credit and Debt Law in New York
Father Son Team of Crooks
We were recently sued and defeated by a man who's son happens to be his lawyer. The older of the tw, was our landlord. We rented an upper from him. We entered into our second lease. 2 months into our second term we began having some electrical problems. Outlets were buzzing and fuses were switching off. Some repairs were made. The problems still existed. My husband and I decided it was time to purchase a home. So we did. The landlord was reluctant to make any further repairs or release us from his ''legal grip'' I am certain that all readers of this writing would agree, there simply was no choice. We were not sleeping good, and were startled at every sound that even resembled an electrical sound. Ultimately we were sued and defeated by default. The judgement is over $10,000. My husband has been seriously injured and is on a disability pension. I do not work. We own our home, we were fortunate enough to combine our savings with a small settlement for his injuries and become mortgage free. We have two vehicles, worth $8,000 each. We have a couple thousand dollars in the bank and as I mentioned we receive a monthly disability pension check. My question to you is simply this. What can this team of crooks take from us?

Re: Father Son Team of Crooks
THey can get their judgment satisfied from you non-exempt assets. Check with your local SHeriff of Marshal for that list. If they won by default you can vacate the judgment if you have a meritorious defense and a reasoanable excuse why you did not defend the matter in the first place. One of the landlord's obligations is to give uyou peaceful enjoyment of the apartment. If the electric was bad you might be entitled to a rebate on your rent. The matter would have to be determined at trial..IMMEDIATELY go to the court where the judgment was entered and file an OSC (Order to Show Cause) to have the judgment vacated. YOU MUST HURRY.
