Legal Question in Credit and Debt Law in New York

Fight against a judgement

I got furniture from big company and it was defected. I called repeatedly to have it fixed. Finally, I told them just come get it. They did not. They stopped doing any mailings or warranty. When the bank called, I told Debbie the problem, I had even written to Lane company for warranty. They told me to continue to work with the furniture company.

I have not heard from them in over 6 or 7 years.

Saturday, someone came to my house and handed my husband a summons for judgement against me. wrong county, wrong last name but it was me, do I have a chance to fight against this? This is still not fixed. I can show pictures of what has happened, it is a double recliner couch and it just pulled apart and sank in the middle. Couch and loveseat.

I am trying to not have a judgement logged against me. I have 20 days to answer this summons but they have mistaken my county.

Re: Fight against a judgement

Your explanation and description of documents are inconsistent so I really can't provide a meaningful response except to say that usually when you finance a purchase the company that extends the credit is separate from the actual furniture company...so you can't stop paying them. If the case is defective you should appear in court and assert all your defenses...You don't say who is suing you so I can't be more specific.
