In New York, if you were not served properly and you have a meritorious (good) defense to the action itself then you most likely need to file an Order to Show Cause. If successful, the judgment will be vacated and most likely the case will be restored to the calendar giving you an opportunity to defend yourself. If you win that case you will have a winning judgment to show the credit bureaus. If you settle the case you can try to use the satisfaction of judgment (given after settlement is paid) but there is no guarantee that will be sufficient to remove the item from your credit report.
