Legal Question in Credit and Debt Law in New York

How to find out if someone filed for bankruptcy

New York Promissory Note - Installment. Even though I did not think I would need your form, for $5 I decided to use your form from the web when I made a loan to a friend. He now threatens to file for bankruptcy if I bring it to a lawyer to enforce the note. He still owes $24,000 but makes $150,000/year. (This is his only outstanding debt.) Can he file for bankruptcy?

How can I find out if he has filed for bankruptcy before (I have his ssn, dob, etc.)and now think he may have gone bankrupt in the past?

He is paying $1,000/month instead of $4,000/month. How long does a judgement take?

Re: How to find out if someone filed for bankruptcy

ANyone can file for bankruptcy. THe requirement is you live in United States. the thing to fear is his getting a discharge of the debt and on your limited facts I don't think he would file or if he did I don;t think he'd be entitled to get a discharge. So go after him and good luck. How does he earn his money? Where does he bank? If you have a proper promissory note you can sue him and get a judgemnt in 60-90 days...

Good luck
