Legal Question in Credit and Debt Law in New York

Girlfriend refuses to bayback charges to joint credit card

last year my girlfirend started a new job and needed a credit card for

her expenses. The company could not issue her a card due to her bad

credit. I gave her a card that was joined to my Amex card - with the

verbal agreement that the card would be paid back each month when

her company reimbersed her - this was satisfactorly done until

December 2004. Between January and May she spent $23,000 approx

on the card - paying back only about $2000. She now says she has

already had and used the expense money and cannot payback what

she owes me. What path of recourse do I have?

Save all of the receipts and any documetnation that shows that she paid for her own items.

In NYC, you need to sue her in Civil Court for the money owed, not in Small Claims. An attorney might take this case on a contingency fee with a percentage of what you get back, plus you pay the filing fees. Feel free to c0ntact me with any questions.

Good Luck
