Legal Question in Credit and Debt Law in New York

Identity Theft victim

I have discovered I have been a victim of an Identity theft that occurred 11 years ago. A collection agency put a hold on my checking account and it has been difficult to obtain information from them. I saw a lawyer and he was not much help, his advise was to pay the $1500 to release the $3000 from the account and forget the case. What can I do? How long can they hold my account? How can I make them release case files so I can study them? I also contacted the City of Buffalo police department and filed a police report on Forgery (I found the person who opened the credit card in question using my name as the primary card holder).

I would be able to assist you with this situation, I've handled many such cases. Thatbeing said, the advice given to you by the previous attorney is understandable. There is not that much debt, and in all honesty my fees alone would probably come close to the amount payable to close the account, as it would be with any other attorney. If yo uwere my client I would advise you that you may take one of two roads.

SInce the amount owed is so close to what you would pay in legal fees you may consider the least riskiest approach and simply paying it off.

If, however, your sense of injustice is sufficient and you chose to continue on, being that you have all of this information against the person who took the card out, there is definately a manner in which you would be able to remedy this situation.
