Legal Question in Credit and Debt Law in New York

Inaccurate Data on Credit report

In the process of trying to fix my credit. I have a few items from 1996/97 that were delinquent. Recently I obtained copy of credit report and noticed an old debt that was to stay on my credit report until 2008. I disputed because this account was delinquent in 1996. Nothing has been paid or promised to pay since that time. I disputed a few times and the CC company somehow kept telling credit bureau that data was valid. Now the date shows to stay on my credit report until 2010. I was advised to contact CC credit department and discuss error. I now receive mail that they will report account sold or transferred. This isn't fixing the invalid dates on the item that technically should be removed from report this year, how should I get this cleared up?

Also, medical bill. I was suffering from psychosis a few years ago. I went to a doctor with away from home care. I had my referrals in place but the insurance company said they never received a bill. So now I have this bill with a collection agency. I had the insurance company call the doctor's office and they will bill insurance company but how do I get collection agency to remove this comment?

You have several options which are too verbose to include in the context of an e-mail. Please call my office at 718-888-3108 to schedule a consultation.

Re: Inaccurate Data on Credit report

The credit reporter is most likely in violation of Fair Credit Reort Act by "re-aging" a debt that is past the 7-yr reporting period. If you win in court they will be responsible for damages and attorney fees.....As for medical, it's a valid debt that went unpaid. If they won't voluntarily remove it you can submit a written explanation to the credit report explainng the error.
