Legal Question in Credit and Debt Law in New York
Information Subpoena
I have received an INFORMATION SUBPOENA (based on a default judgment issued on a consumer credit card debt), asking for info about my finances. I don't have a personal checking account, but I do operate a small home-based business (a sub chapter S corp). Can they attach that account? I only make $16,000 per year. Our car is in my husband's name, but we do own our house outright.
Can they go after my husband's wages. He also has a small business. (sub-chapter S)
They want a copy of our income taxes. Do I have to give them that?

Re: Information Subpoena
Yes I think they can. If they have a judgment they can demand you respond to questions and IF the subpoena is the right kind they can demand you provide tax records. If you have interests in corporations that make money your creditors can reach those assets. A business is like a car..it has value and if you own it it is at risk.
