Legal Question in Credit and Debt Law in New York

Joint bank account

I have frozen a bank account of someone I have won my court case against. Its a joint account so the sheriff told me to get a ''turnover'' order. The court clerk gave me the form. In filling it out I see that it has a place for the name of the bank and the name of the defendant, but not a place to enter the name of the other person whose name is on the account (It doesn't look like a family member of the defendant). How does this other person get notified that an account with his name on it is being taken? I don't want to get in any trouble, and the clerk didn't really have an answer.

Re: Joint bank account

Do you know how much money is in the account? Is it less than 1/2 of the judgment?

Re: Joint bank account

You do not have to do anything. The entire account can be levied upon. The bank will inform everyone.

Re: Joint bank account

you have done very well so far. It is not your responsibility or duty to contact the 2nd owner of the joint bank account. The bank will perform this duty. The 2nd person took on the risk of this and other problems when he/she decided to open a joint account with your debtor. you are welcome to a consultation for no charge at my office at 42 west 44th st, ny,ny please call for an appointment first. 646-591-5786
