Legal Question in Credit and Debt Law in New York
judgement
On July of 2004 I was awarded a judgement in the amount of $168,800.00 againest and ex boyfriend in the state of Nevada. He fleed to Long Island, NY. I now live in California. How do I go about collecting this judgement or garnishing his wages. I know where he works, and have his SS#. I also have an address for him in New York. He has no assests to my knowledge but does have a good job that he has worked at for a couple of years.

The first thing to do is to get the judgment docketed in Nassau County where he is located. Once that is done, you can go ahead and enforce the judgment either by serving a notice to garnish his wages against his employer or you can turn it over to the sheriff who will seize his assets for you.

The award will be a foreign judgment here in New York. It will cost a few bucks to have it entered here,
Then, after that, it needs to be collected, My office does a great deal of collection work where we represent credit card companies and car lenders in this type of work.

With an out of state judgment, you would first need to have the judgment transcribed or transferred to NY state and preferably to the county where your ex resides you then can proceed to steps of judgment enforcement, such as sezing any assets or garnishing wages. Out of state judgments can be a little "tricky" sometimes. However, sister state jurisdiction attempts to make such judgments less difficult to collect. Any and all collections can be fairly difficult, especially if the judgment is against a "transient" invidual who may or may not have the necessary assets to satisfy the award amount, unlike with judgment awards against major companies or businesses often time. So, here, your best option would be to retain an attorney to make your "task" alot less difficult herein.
