Legal Question in Credit and Debt Law in New York

Judgment Assignment

I won a civil law suit in the supreme court, Nassau county. The judgment was for $81,000. i hired a judgment collection agency, assigned judgment to them. They did not collect any money and also went out of business (tel. disconnected etc.). I asked the owner to submit paperwork to the court to have judgment reassigned to me. She said she would, I thought she did. This was about 1 yr. ago. Now, i found a new collection agency that wants to work on the collection of this judgment. They find that the judgment is still with the original agency that does not exist anymore.

Q. What can i do to get the judgment reassigned so i can assign it to the new agency? I do have the owner's tel # and her new place of work but she will not return calls. how/what can i do to prove to the court that the assigned party does not exist anymore and the judgment to be returned to me? Thanks.

Re: Judgment Assignment

Depending on the wording of the assignment you signed you should be able to file a revocation of assignment. otherwise, a court proceeding may be necessary.
