Legal Question in Credit and Debt Law in New York
judgments while not in the country
There was a default judgement granted to a creditor while I was living in another country. The papers were sent to my mothers house which is where I usually live. According the papers that I just saw, I needed to appear in court or I could dispute after 30 days but since I was in another country, even if I had recieved the papers in time, there would have been no way for me to have appeared in court. Is there anything that I can do about this judgment now that I am back in the U.S?

Re: judgments while not in the country
Yes, a special motion by Order to Show Cause would usually need to be filed in this type of situation. That should cause the case to be reopened and allow you to have your day in court. This area of law is our specialty, however, we would need some more information before making a complete and proper determination.
