Legal Question in Credit and Debt Law in New York

Legal bank holds

What is the procedure for placing a legal hold on a checking account? Doesnt the account holder need to be notified? How can someone prove that a is mistake. There is a legal hold on mine and I have no idea what it is for. The amount is over $8000. I am receiving welfare and have no idea what this is.

Re: Legal bank holds

You can get the account quickly unfrozen by filing a show cause on the grounds that (1) it was a mistake, and/or (2) the frozen funds are exempt from collection (welfare).

If you have a judgment, you do not need to be notified before your account is frozen. The bank needs to give you the contact info of who has the hold.

They are not entitled to take your account if it consist solely of your welfare $$.
