Legal Question in Credit and Debt Law in New York

legal responsibility of auto loan

vehicle is titled in both my sons name and mine, it is registered & insured in my sons name, the loan is in my name with my son paying payments he is buying vehicle from me but, can not get a loan, if he fails to make payments, can i sue him?

The repsonse by Nitzberg is wrong though legally you can sue anybody for anything at anytime. The question is can you win? Here, you borrowed money to pay for a car that is half yours and half your sons. In the absence of any agreement, he has no obligation to pay you for the car (unless he agrees in writing to buy it) or pay you back for half the loan. So you would lose if you are suing him for money you figure he owes you...

If he is over 18, yes. If under, the law is unclear.

I cannot see how. The loan is in your name. Absent some agreement bewteen you and him, what can you sue on?
