Legal Question in Credit and Debt Law in New York

Levy on bank account

I know that there is a limit to the percentage of a paycheck that can be garnished. I just had a levy placed on my joint checking account whch had my only income from my wife's job and my job. The underlying judgement was only against me. It seems strange that a salary is protected but when it is deposited it loses all protection. My rent check bounced. In Florida I wouldbe protected. Do I have any remedy in NY?

Re: Levy on bank account

No protection ... salary is ongoing. a joint checking is there...and it is by operation oflaw presumed to be owned completely by each of you. The time to have taken action was before the judgment was entered.

Good luck.
