Legal Question in Credit and Debt Law in New York
Loan repayment
I lent a friend $4,000 about 7 years ago. Our friendship dissolved about 4 years ago, and I very recently asked for the money back. She said she'd do the best she could. I don't have a written contract, but I have the cancelled checks I wrote plus a thank you card she wrote me after the loan was made. It was never considered a gift by either party, and it was always assumed the loan would be repaid when the borrower was able to repay it. The borrower currently owns a house, an expensive car, an expensive phone and she and her wife both have diamond rings. I'm pretty confident she can afford some kind of a payment plan. If she gives me a hard time about repaying the loan, what are my legal options?

Re: Loan repayment
Her THANK YOU card probably is a sufficient written acknowledgement by her of this debt to be used to support a Small Claims Court lawsuit against her brought by you.
