How long do I have to send a first time invoice to a customer? We are both located in NYS. How long do I have to bring this customer into commercial claims court for none payment?

I do not know what you mean by "first time invoice". Normally, an invoice is generated after a service is performed or materials are delivered.

The statute of limitations (time to bring an action) on a contractual claim is 6 years from the date of performance. However, for goods delivered under the New York Commercial Code, the limitations period is 4 years.
