Legal Question in Credit and Debt Law in New York

mislead by credit counseling agency

A year ago, I joined a credit counseling service to help me structure a way to pay my debts faster and with less interest. About a month ago, I found out that my account with American Express had been charged off without my knowledge. I discontinued dealing with the credit couseling agency and still sent out monthly payments to all the creditors. I have not received any statement from American Express for about 5 or 6 months. Should I stop sending them payment? Is the credit counseling agency liable for any wrongdoings?

Re: mislead by credit counseling agency

This is not a new problem. You are in good company - this happens often.

First, let me confirm your statement. You say that your crdit card has been 'charged off'. This indicates charges have been made on the account without your knowledge?

Or does this mean the account has been 'closed'?

please get back to me and we will discuss this further (at no fee - just a continuation of the 'lawguru' question).

You are welcome to a consultation at my offices at 42 west 44th st, New York, NY for no fee. Please call for an appointment first, (646) 591-5786.
