Legal Question in Credit and Debt Law in New York
I was owed money and I sued the individual in small claims court. We had a stipulation of settlement and affidavit upon default. The debtor failed to pay as agreed, do I have to start process all over again from the start and pay a new fee or can it be restored to court with out additional processing fees?

Generally, it is my understanding that you may file Judgment with the clerk under the settlement and affidavit upon default. Therefore, you would not have to re-start the process.
