Legal Question in Credit and Debt Law in New York

paying a care payment late

I have a car payment that i couldn't pay for 4 months. I notified them this and they only gave me 2 months way. i started paying them back and every other week they have been calling a pushing me into paying them more then i can afford. I have payed at least once a month for the last 2 months and i arranged to pay them every 2 weeks but i couldn't do it this past week and figured no problem I'll pay them the beginging of this month. So for the past 2 months they have received a payment. They called today and backed me into a corner and said that if i son't pay $1200 this week that they're going to repo my car. I only get payed $900 every 2 weeks. I would like to work something out a little easyer but they wont even listen. Is what they're doing legal? What should I do?

Re: paying a care payment late

You owe the money. They own the car. It is legal.

Good Luck

Re: paying a care payment late

Without checking the agreement it is impossible to tell whether they are within their rights or not. I will say that when you bought the car by borrowing the money you made an agreement to pay a certain amount each month until you completed the deal. You may want to bring the documents you signed to an attorney who can tell you whether or not you are being cheated. If the numbers add up and you owe on the car, the lenders are within their legal rights to demand the money...what I can't tell from here is whether they are making up numbers and forcing you to pay...(adding in late charges and fees that an attorney may be able to avoid). GO SEE A LAWYER!!!
