Real from fake Summons
I got a summons in the mail but it looks different than others I have received. I am trying to work with the law firm but they say it has been filed with the NYC civil court since april. I have not heard anything from the courts nor has there been a judgement against me. How can I tell if the form is real or a bluff?

the real summons and complaint must have an index number on it. Call the Civil Court and give them the index number...if it is there...and if the court has it...its real. By the way, no one sends you anything from the court. you have to go there and file your ANSWER to the complaint that is attached to the summons...then, and only then, will you get a notice from the court as to when and where to appear (for a conference). If you don't file an answer the plaintiff can enter judgment and the first thing you know is your bank account (if any) will be seized and your wages (if any) will be garnished. CALL THE COURT TODAY. Finally, there are many laws that are on the books go protect you from fraudulent acts by collection attorneys...NO collection attorney will risk big fines by sending fraudulent court documents with their name on them! It would be like writing a bank robbery note on your own personal check! So my guess is the summons is REAL.

Assume it is real and interpose an answer. This is probably the second summons and sent as a precursos to a default. Time is of the essence. Answer the complaint and file the answer with the court. The court has no obligation to notify you of anything. That is the purpose of the summons.

call the clerks office and give them the docket number and they will give you all the info.
