The statute of limitations is 6 years. However, many collection agencies are buying the debts and they admit, they go after people who don't know the law. I owed $650 from 2003 when they cut my dog's tongue off inserting a tube for an MRI. I was busy in law school and fighting my dog's cancer but there were several options for me to sue. So, I am not paying the collection agency. However, you need to find out what they did that a martial is calling you-he does that usually when it is adjudicated. Collection agencies are so slimy maybe they did not go to court and the "martial" is someone pretending (my classmate could not find a job and worked for one for a while. He quit literally 5 minutes after we got sworn in-he called from the BQE and said "I quit NOW"). However, if you do make a payment now, the statute of limitations starts all over again so if you pay that money... If you are on Long Island, call me at (631) 848-1204 so I have full info. Perhaps I can send them a lawyer's letter reminding them of the statute and stay away from my client.
