Legal Question in Credit and Debt Law in New York

Removal of a levy on my bank account

As the result of an old unpaid debt, a creditor (through a lawyer) has placed a levy against my checking account. When this was done, there was a small account balance in the checking account so the debt (which totals approximately $2500) reduced by approximately $00. I am currently unemployed, and earning no income.

What can I do to have this levy removed so that I can use my checking account (make deposits, withdrawals, etc.)? I know that the levy can only be removed by the lawyer for the company to which I owe the debt. How do I go about getting this done? Please note that I am not in a position to pay this debt in full at this time, and the lawyer for the debtor has informed me that payment arrangements (in small monthly amounts) are not an option.

Re: Removal of a levy on my bank account

Since ther is a judgment against you, and now a restraining order on your bank accout, the only other option to remove the levy is to file bankruptcy.
