Legal Question in Credit and Debt Law in New York
reporting later date to extend sol
I recently reviewed my credit report and saw that the oc (victorias secret) was letting a creditor collect my debt on their behalf. my problem is the date of my last activity for oc was dated back in 1998. the creditor that is trying to collect the money owed is reporting a date of last activity as 12/2000, which is extending the sol. What can I do to make them report the correct date. I called them and they told me it is perfectly legal for them to report a later date because that was when they received my debt.
please help. any responses will be greatly appreciated.

Re: reporting later date to extend sol
Fair Debt Collection is an emerging area of contention.
The creditor has no right to reprt a later date. The later date has an impact on your credit report. As such, the later date is a violation of the law.
You must write to the creditor and repeat what I have indicated in the second paragraph. If they resist, then give me a call and you can sue them for the willful mis-statement and collect money from them.
