Legal Question in Credit and Debt Law in New York

Representation in Small Claims Court

I have two claims coming up in Small Claims Court. They are very small, and not worth my cancelling other patients, but I want to get the judgments, and do not think that the defendants will show up. Can I have someone else (not a lawyer, because the amounts are too small) represent me in court? Could the person who does my billing speak on behalf and be heard if I am not present, myself?

Thank you.

Re: Representation in Small Claims Court

1. your friend/employeee needs to have a notarized 'power of attorney'

2. you must present the records of your business that show the debt. In your case, the appointment book would show the appointments (that services were rendered) and then a notarized statement from you that no payment was made.

There must also be a notarized statement that the appointment book is your appointment book and no changes or alterations have been made except ongoing 'postings'.

That should be adequate for your purpose. Make out the small claims form to indicate you are bringing the action for a 'sum certain'.
