Request for Judicial Intervention & IAS Motion
I received a letter from plaintiff who will move an IAS motion term of court, for an oder granting summary judgement in favor of plantif.

I (defendant) signed a retail installment contract for the purchase of a 1998 Land Rover, on or about July 2001. On or about April 25, 2004 my vehicle (1998 Land Rover)was reposseed.

The dealership (bank) is looking to collect the balance of sale of vehicle against the unpaid balance at time of repossession; and is asking the court to request a judgement against me (defendant) for difference in balance.

Please advise me as to what actions I need to take. The motion will take place on August 30, 2005, 9:30am

OK - this is all according to procedure. But it is not over yet. There are a variety of defenses that you can plead that may be helpful.
