Legal Question in Credit and Debt Law in New York

Scam??

Is there a statute of limitations on time for a company to present an overdue bill? (at least 25 years with no notification of an unpaid bill),. We believed all items were paid in full, when we quit dealing with the company. Now, they have turned over their accounts to a collection agency and they want payment for something, we don't know what it even is. There are other reports of people having their credit ruined by these claims being posted on their credit reports. What can we do?

In NY, it can depend on what kind of debt it is exactly and how it came about, but in any event, 25 years is WAY too long.

However, you must be sure that during that time there was no attempt to collect by them, and no payment made or acknowledgment of the debt by you. There are many response letters for this problem out there on the Internet which you can use to draft a response. Or, you might consider having an attorney do one for you. Many will write a simple letter for a reasonable fee.
