Legal Question in Credit and Debt Law in New York
Served in wrong state
My parents recently informed me that they received in the mail papers to inform me that I was being sued for credit card debt and that a court date had been set for 3 weeks from now. I no longer live with my parents, and havn't for 6 years. I never used their address for this credit card. They live in Ohio, I live in New York. Is this summons still valid?

No one knows until after the issues is litigated...by that I mean if you fail to answer, an default will be attempted. If that is successful, then a judgment will be obtained against you. In that case the judgment is valid until you remove it. The question for you is whether to sit back and do nothing and risk a judgment, or get counsel and attempt to defend the suit and avoid a judgment.

I strongly recommend you or, preferably, your representative appear in court to answer the claim against you and contest jurisdiction. A judgment against you will ruin your credit and cause you great hardship down the road. Don't let it happen!
