Legal Question in Credit and Debt Law in New York

Small Claims

I had planned to live with my friend and had moved in. 28 days later I had moved out because of financial reasons. I had never signed an agreement, but she was under the assumption that I would pay half of the utilities for the time I was going to be living there. I had paid for the month that I lived there and had said that I would pay for half of the utilities for the 3 months that I would not be living there. I did not have enough money in my account to pay for the utilities and she is sueing me for ''Reinbursment for expenses while living at the apartment''. Do I still have to pay her the amount?

Re: Small Claims

I believe not. Unless she can prove that you agreed to pay the expenses she is suing you for, then she should not win anything. When you go to court, do your best to appear calm, cool and collected, and explain the situation logically to the judge. Do your best not to get upset by any "bait" (something she might say just to get you mad) and I would think you should prevail. Good luck!
