Legal Question in Credit and Debt Law in New York

Spouse dies with debt and no estate

My father passed away with credit card debt, only in his name. Not my mother's. He died with no will and no estate, two assets, a house that is in both his name and my mother, his spouse and a car. Is she responsible for the debt and can they make her sell her house and move to pay the debt?

Re: Spouse dies with debt and no estate

no. When he died the house became your mother's 100%. The car is probably not worth worrying about. She is not responsible for his debt.
