Legal Question in Credit and Debt Law in New York

Statue of Limitations

A N.Y.Collection Co. purchased a 10+ year old account from a mail order book company in the same state. The account was disputed many years ago because I never received the books. The collection company has recently placed this info on my credit report as an unpaid debt to them(the collection company).I want it removed. Help!

Re: Statue of Limitations

They can not "re-age" the debt and place it on your credit report. You need to threaten them with a FDCA law suit and contact the credit report co with same.

This debt is no longer legally collectible, as long as you have not made any pymt in the last 6 yrs nor acknoledged the debt as yours and an intent to pay it.

You may have a lawsuit for violation of the Fair Debt Collection Act. Please call me if you have any questions. We would have to review your paperwork.
