Legal Question in Credit and Debt Law in New York

Statute of limitation to collect debt

I received a collection notice about an outstanding telephone bill from 11yrs ago. I have never received a bill or notice that there was an outstanding debt. Has the statute of limitation to collect passed? Would it still appear on my credit report if the statute of limitation has passed?

Re: Statute of limitation to collect debt

The SOL is 6 yrs from the time the debt accrued. Most likely the date you missed/failed to pay the bill.

However, if they have a judgment agaist you already, they can pursue it for 20 yrs (on credit report for 7).

If they have a judgment and you were never served, you need to go to court to vacate the default judgment for lack of service (no jurisdiction).

Once it is vacated, they can not re-file re: SOL's.
