Legal Question in Credit and Debt Law in New York

stipulation of discontinuance

Had a cc bill that was turned over to

a law firm. Paid what the

original correspondence asked for and

then they wanted another $520

which they said was for legal fees for

going to court. I was never served a

summons by them, cannot find the

index number that would match my

name etc. , court has no record of

judgment against me. Wrote the firm a letter asking for

explanation. Yesterday, one year

later, received a letter for Stipulation

of discontinuance and asking me to

sign one and return it to law firm, and

take another copy to court and pay a

$35 fee. Court has no record and I

don't know what this is. Should I

sign it? What is a stipulation of discontinuance?

Re: stipulation of discontinuance

A stipulation to discontinue an action is just that, an agreement that an action should be discontinued.

I cannot think of a reason why you should not sign and return the document.

Mike.
