Legal Question in Credit and Debt Law in New York
sue for personal debts
4 years ago I did one of the stupidest things I've ever done and co-signed for a car with a family member. 2 years ago I was sued (hot him) for non payment. I had to use equity in my home to pay for the suit which I'm still paying back. I've been trying to work with my cousin on a payment plan after that incident. He paid back a fraction of what he owes, but has been dodging me since that time. Now I'm fed up with chasing after him and want to take him to court. If I still have my original documentation from the lawsuit, can I still take him to court after that much time has passed?

Re: sue for personal debts
Yes - the statute of limitations on a contract is 6 years. In addition - the breach did not happen until 2 years ago.
