I was sued without knowing it
I just found out 11 years ago someone opened a credit card under my name (and he used his name as well) to open a joint account. He made a few payments but stopped and last December I found out there was a hold on my checking account for $3400. Apparently there was a judgement against me and a court order was issued to hold my checking account. When I contacted the collection agency, they asked me to pay $1700 to release the account, of course I said no, and talked to a lawyer; his advise: pay them and it will go away, I didn't. I was never contacted about the suit because the address used for the credit card application was never mine. I filed a police report against the other character and I tracked him down, after a ''conversation'', he agreed to pay but he hasn't. I also filed an Identity theft report with local police department (in buffalo, where the crime took place) and contacted the three credit report bureaus which all told me the account in question was not in my credit report. The Collection agency is not helping much and I'm running out of resources. Please help

File a motion to vacate the judgment. Assert your defense and your reason for not responding to the papers you were allegedly served.
