Legal Question in Credit and Debt Law in New York

Being Sued

I am being sued for money my step mother lent to my Husband. While he was in Iraq, I paid her the amount she gave me. This amount was more than she lent to him. Her attorney has a paper that is not notarized, which I did not sign stating the amount of which would be paid. I have wittnesses, from my caregivers because I was ill when she came to collect her money. I also have a receipt of fact. I have to answer the petition by tomarrow, which was also served to one of my caregivers that looks like me. She however speaks little english, so took the paper and gave this to me. I am unsure how to approach this situation, as I am not retaining an attorney, plus this woman is under investigation for fraud, living in a low income housing complex and supposedly working under the table, howerver not reporting her income. She is on Social Security limited income. She did in fact commit the fraud, however no real investigation was completed. What do I do?

Re: Being Sued

You must immediately go to the Court clerk and express an interest to answer the complaint. The Court clerk should give you the proper papers to serve an answer.

Mike.
