Summons from collection agency
This morning I was served with a summons to answer a complaint by a collection agency for a credit card debt. This is my husband's credit card. We fully intend to pay the overdue balance, which now amounts to over $7,000 with late fees and interest accruing. The account was always in good standing and paid on time until my husband lost his job right after we purchased our house. We used up our savings to stay on top of our mortgage payments and could not pay this bill. At the present time, we are trying to refinance our house in order to pay this debt. Aside from bankruptcy, which we do not want to do, what are our options? We planned on paying the creditor in approximately 6 months from our tax return, but it does not seem likely that they will wait. Can they freeze our bank account or garnish my husband's pay without first notifying him? Does my husband need to go to court? We cannot afford an attorney.
