Legal Question in Credit and Debt Law in New York
Summons following Discontinuance
I recieved a notice of discontinuance for a credit card debt I accrued six years ago, a month later I recieved another summons for the same case that was discontinued. Can they do this? Also, what can they do legally if I do not pay this debt?

yes they can. You may have legal defenses to their 'new' action. If you don't respond they will get a judgment and restrain your bank account (if any) and/or garnish your wages (if you are working). They can get 10% of your GROSS SALARY per pay period. If you own property (like a house or car) they can seize and possible sell your property to satisfy the judgment..
