Legal Question in Credit and Debt Law in New York

Summons issued but exhibits possibly invalid

I received a summons taped to my front door for a previous debt in both my husbands and my names. The attorney listed on the summons has never contacted my before, that I remember ( it was listed with them over a year ago). According to the summons and exhibit attached, the debt occured during a six week time period and I signed the contract. However according to a second exhibit, the amounts listed were from a different time period . What are our options regarding this summons and what do we do next? Also since I signed the contarct for our child, can they freeze assets in his name only? I am currently unemployed and have no individual assets only our joint house and vehicles.

The complaint needs to be answered and the answered filed with the Court. If your signed it, you are on the hook and so are your assests.

Good Luck

You will have to file either an answer or an appearance against the summons and try to have it dismissed. You should do so within 20 days of receipt of the summons.

Feel free to contact me with any further questions you may have or if you would like me to assist you on this matter.

Kind regards,
