Legal Question in Credit and Debt Law in New York

unauthorized charge

I was charged 300.00 dollars from my bank account with out my authorization from a credit card companie who needed a 200.00 dollar deposit to start me off with establishing credit. Never recieved a call, never recieved a letter,never recieved the card and found out for my self as i went to the bank to pay a bill that i had no money. i was not even let know about the '' computer malfunction'' To top it off when i called them they said they dont even know when they will be able to give me back my money. Can i sue them for that?

If you did not authorize a company to access your bank account and they withdrew money you can sue them. BUT, what are your damages?

If it is $300...you can go to small claims court.

But, if this was for a secured credit card...the money is in your credit card account. You could close it and ask for your money to be refunded.
