Unfair Judgment

I have been sued by a debt collector out of the blue. I was never contacted or served papers regarding this debt from Texas. I dont even know what debt this could be from Capital One. I went to get money from my account and they froze my checking account. Can debt collectors place a judgment on me without notifying me or serving me ? I have yet to contact them since i think i have a case to get this judgment vacated. Please let me know what should be my next step. I went to go get a copy of the case and there is no copy of attempt or service...this was pointed out ot me by the court clerk. Dont I have to be served ? My checking account is frozen and I am now living on emergency funds. Please advise ...Jessica

Go to the court--in your case probably the City Court in Yonkers -- and ask for an order to show cause to vacate a judgment. They should be able to help you.
