Legal Question in Credit and Debt Law in New York

Wage Garnishment for Debt Collection

My dad has a credit card charge that went from $3000 to $8000 in 5 years because he was not able to pay it. They have now frozen his bank account that he recieves his Social Security and Workers Compensation checks. Can the bank freeze the account knowing that it is illegal to hold Social Security and Workers Compensation Wages? Is there a website where I can print the law and fax it to their law offices since nobody wants to release the money? Thanks so much in advance for an advice...

Re: Wage Garnishment for Debt Collection

They don't know what the source of the funds are

in your dad's account...there is a procedure that your dad must commence to that show where the funds come from (and that they are beyond the reach of your dad's judgment creditors). Get your dad to go to the court where the judgment was entered and explain this to the PRO SE (Pornounced PRO SAY) clerk and he/she will assist your dad in the filing of the proper papers...

DO IT NOW...

what your dad should do is open another account...in another bank, then try to secure the assets that are frozen. This needs to be done through the courts.

Good Luck
