Legal Question in Credit and Debt Law in New York

How Do I Take My Name Off

My wife and I together signed for a water softner which cost $4,300.00. We were making monthly payments on it, until I found out that she no longer wanted to be married. No paperwork has been filed for a divorce yet, but I'm sure it will later. But when the collection company called, my wife just gave me the phone and I really didn't know what to do. So I was making the payments. A year later, I hurt my back and since then I've been out of work, and haven't made any payments since then.

She is the signer and I co-signed. My question is how can I get my name off of the loan application?

Thank you for your time.

You cannot...but if a suit ensues, it will be against both of you, in the for what it is worth department.

Speak with your matrimonial attorney about this.

Good Luck.
