Legal Question in Credit and Debt Law in New York
I have won a judgment on money and stamp collection against two persons living in New York from the federal court in Pennsylvania. Two guys are hiding themselves and their assets. I do not know their current address but I have a defendant's cancelled check. They have disobeied the court's discovery orders twice during the discovery. Now I want to find out where they hide their stamp collection and their address and start to collect judgment. My questions (1)How can I file a motion to restrain defendant to move their stamp collection and have them to disclose where their stamp are?(2) How can I have the bank which I have the cancelled check disclose the defendan's current address, his account information, and freeze his acount? Please provide your advice step by step including the federal rules and New York state rules guiding this procedure and form I have to use in the motion I have to submit. Thanks!!!

What you are asking in the form of an answer is too large and complicated. I suggest purchasing from the NYS Bar Association the following book: Debt Collection and Judgment Enforcement (2008 - 2009). You can purchase the book by telephoning the NYS Bar Association at (518) 463-3200. The publication may also be found at the law library located in the Supreme Court in the county where you reside.
