Legal Question in Credit and Debt Law in New York
wrongfull judgement
Over seaven years ago I was sold a car that was no good. After turning the in the plates and calling the company to take the car back, the fianance company tried to get me to pay for the car. After speaking with the lawyer and sending him signed statements from the people who worked on the car,I was told by the Attorney the case was closed.two weeks ago, I recieved papers from someone who said he was the new attorney for the fianance CO. And that he demand payment. At the same time he also send papers to my place of employment. I am at a loss as to what to do next. The papers also stated that six years ago a judgement was filed against me, yet I was never served with any judgement papers. Any help with be greatly appreciated.

Re: wrongfull judgement
Find out where the judgment was filed. Go to that court, speak with the PRO SE (pronounced PRO SAY) clerk and ask how to file a motion to get the judgment vacated (thrown out). Claim that you were never served with the summons and complaint and had NO KNOWELDGE that a law suit was commenced against you. THe law is, however, that a finance company is not automatically bound by the defects in the automobile...you ma have a problem still...
