Good Evening,

My question to you is my brother has been charged with a 220.16 FB (CRIM POSS CONTRL SUBST-3RD B Felony) He was supposedly being watched and follwed and the undercover cops pulled him over and threatened they knew he had more and know where he lives. He then decided to cooperate and lead the Narcotic cops back to his home and he lead them to find a 1/2 kilo of cocaine. My question to you is why was his bail remanded? And he has been incarcerated since Dec. 2 with all of his hearings dates adjourned and postponed. Why is this process taking so long? He has no prior record could this work in his favor? Any information on this case would be helpful. We are wondering why his legal aid attorney has been so quiet and are wondering if he is working in his favor or not. We may need to seek an alternate council.

Your brother is facing very serious charges and you should not expect to have a trial on this case until the end of summer or fall at the earliest. That's just the way it is in NYC. This is not the fault of his current lawyer. Legal Aid does a fine job, though they are a bit overworked. Good luck.
