Legal Question in Criminal Law in New York
1st degree assault
last year after finding out that a person masterbated in front of my son, I went to this persons house, went inside and assaulted him. I punched him then bit off part of his ear which never was able to reattach. No punches were ever thrown at me. There is a statute of limitations of 5 years. The person was arrested for endangereing the welfare of a child and sentenced to probation. If he would press charges now after 14 months, what would likely happen to me. Would the DA have any sympathy for me? What are the odds that the DA will drop the charges?

You may be charged anytime within the statutory period, which for a crime like this could be 5 years.
If you ever do get charged all the circumstances may be taken into consideration however, you may still be charged

You can be charged any time until the statute of limitations runs out but if the other person was charged and sentenced 14 months ago, the likelihood that you will be charged this long after is very slim.
That being said, in Nassau County anything is possible. You may want to consult an attorney and get into more detail to make sure that nothing is pending against you.
