Hi - For 1st degree rape in NYS, do government officials have a one year Statute of Limitation for someone to press charges against them? Also in general, what is the Statute of Limitation for 1st degree rape in NYS? Lastly, the definition for 1st Degree Rape Includes: "Occurs when one party engages in sexual intercourse with another party through the use of force such as threat of death, injury or kidnapping, or when the victim cannot give consent due to being physically helpless". What is considered physically helpless?

Rape in the First Degree is one of the few crimes which has no statute of limitations. Most felonies have a five year statute of limitations, but Rape in the First Degree is exempted from that limitation.
