I need to hear more of the facts but you may have a civil rights violation claim against the police and City (assuming this was in NYC) for false arrest. I am a former State and federal prosecutor and now handle criminal defense, personal injury, and civil rights cases like this one may be. Please feel free to check out my web site and contact me. You need to serve a Notice of Claim within 90 days of the incident to preserve your right to sue and I can help with that.

It's sounds like a classic Bivens claim. I urge you to consult with counsel immediately.

If he is prosecuted in Family Court, you will find out the details. If he is not charged, your son has a good lawsuit
